    Terms and Conditions

    These Terms and Conditions ("Terms") govern your access to and use of the website lightsbyluma.com (the "Website") and the purchase of any products offered for sale through it under the brand "LUMA LIGHTS". Please read these Terms carefully before placing an order. By placing an order with us, you confirm that you accept these Terms and that you agree to comply with them.


    If you do not agree to these Terms, you must not use the Website or place an order.


     


     

    1. About Us

    LUMA LIGHTS is a trading name of Florian BOICHUT, a sole trader registered in France under the auto-entrepreneur regime.

    In these Terms, "we", "us" and "our" refer to LUMA LIGHTS. "You" and "your" refer to the customer placing the order.


    We are a business established in France selling lighting products ("Products") to consumers located in the United Kingdom. We are not a UK-incorporated company. Although we are established outside the UK, the laws of the United Kingdom (and, where applicable, the laws of England and Wales) protecting consumers continue to apply to your purchase, as set out further below.


     


     

    2. Definitions

    In these Terms:


    • "Consumer" means an individual acting wholly or mainly outside that individual's trade, business, craft or profession, in line with section 2 of the Consumer Rights Act 2015.

    • "Contract" means the contract for the sale of Products formed in accordance with clause 4.

    • "Order" means the request you submit through the Website to purchase Products.

    • "Working Day" means any day other than Saturday, Sunday or a public holiday in England.


     


     

    3. Eligibility and Use of the Website

    To place an Order, you must be at least 18 years old and legally capable of entering into binding contracts. By submitting an Order, you confirm that this is the case.


    The Website is intended for personal, non-commercial use by Consumers based in the United Kingdom. If you intend to purchase as a business, please contact us prior to ordering, as different terms may apply.


    You agree not to use the Website in any way that is unlawful, fraudulent, or harmful, or in connection with any unlawful, fraudulent or harmful purpose.


     


     

    4. Orders and Formation of the Contract

    4.1 Product information

    We take reasonable care to ensure that descriptions, images, dimensions, colours, materials and prices on the Website are accurate. However, slight variations may occur, particularly due to screen colour calibration. The packaging of Products may also vary from any image shown on the Website.

    4.2 Order process

    You place an Order by selecting the Products you wish to purchase, adding them to your basket and following the on-screen instructions to checkout. Before submitting your Order, you will have the opportunity to review your selection and correct any errors.

    4.3 Order acknowledgement

    After you place your Order, we will send you an order acknowledgement by email confirming that we have received it. This acknowledgement does not constitute acceptance of your Order.

    4.4 Order acceptance

    The Contract between you and us is formed only when we send you a separate shipping confirmation email confirming that the Products have been dispatched. If we are unable to accept your Order (for example, because of a stock issue, a pricing error, or because we cannot deliver to your address), we will inform you by email and will not charge you, or will refund you in full if payment has already been taken.

    4.5 Cancellation by us

    We reserve the right to refuse or cancel any Order before dispatch where:


    • there is an obvious pricing or description error;

    • we have reason to suspect fraud or unauthorised use of payment details;

    • we are unable to obtain authorisation for payment; or

    • we are unable to comply with applicable laws (including export, customs or product safety rules) in respect of your Order.


     


     

    5. Prices and Payment

    5.1 Currency and prices

    All prices are displayed on the Website in pounds sterling (GBP £).

    5.2 VAT and import charges

    The price displayed at checkout is the price you pay. Where the consignment value is £135 or below, UK VAT at the prevailing rate is included in the price displayed and we collect and account for that VAT in the United Kingdom. Where the consignment value is above £135, the goods are imported into the UK and the relevant import VAT and any customs duties are payable by the recipient on importation, unless otherwise expressly stated at checkout. We will make this clear before you complete your Order.

     

    5.3 Delivery charges

    Delivery charges are not included in the Product price unless otherwise stated. They are calculated at checkout based on the delivery address and the delivery option chosen, and are set out in our Shipping Policy.

    5.4 Payment methodes and security

    We accept the following payment methods: Visa, Mastercard, American Express, PayPal, Apple Pay and Google Pay. All transactions are processed in pounds sterling (GBP). Payment is collected in full at the time you place your Order. By submitting payment details, you confirm that you are authorised to use the relevant means of payment.

    Your payment information is encrypted and processed securely through Shopify Payments. We do not store your card details on our systems. In the event of a failed or disputed payment, please contact us at contact@lightsbyluma.com.

    5.5 Pricing errors

    If we discover an error in the price of any Product you have ordered, we will contact you to inform you of the error and to give you the option of continuing to purchase the Product at the correct price or cancelling your Order. If we are unable to contact you, we will treat the Order as cancelled and refund any sum paid.


     


     

    6. Delivery

    6.1 Delivery area

    We deliver to addresses within the United Kingdom (England, Scotland, Wales and Northern Ireland). Some remote areas may be excluded or attract additional charges, as detailed in the Shipping Policy.

    6.2 Cross-border shipment

    Products are shipped from France to the United Kingdom. Delivery times, carriers and customs handling are set out in the Shipping Policy, which forms part of these Terms.

    6.3 Delivery times

    Estimated delivery times are provided as a guide and are not guaranteed unless expressly stated. Where no delivery period has been agreed, we will deliver the Products without undue delay and, in any event, within 30 days of the day on which the Contract is formed, in accordance with regulation 42 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

    6.4 Late delivery

    If we fail to deliver within the agreed period (or, in the absence of an agreed period, within 30 days), you may give us a further reasonable period within which to deliver. If we fail to deliver within that further period, you may treat the Contract as at an end and we will refund all sums paid under the Contract without undue delay.

    6.5 Risk and title

    Risk in the Products passes to you when the Products are delivered to the address you have provided (or to a person identified by you to take possession of the Products). Title in the Products passes to you when we have received payment in full, including any delivery charges.


     


     

    7. Right to Cancel (14-Day Cooling-Off Period)

    7.1 Statutory right

    Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are a Consumer you have the right to cancel this Contract within 14 days without giving any reason.

    7.2 Cancellation period

    The cancellation period will expire 14 days after the day on which you, or a third party (other than the carrier) indicated by you, acquires physical possession of the Products. Where Products in a single Order are delivered separately, the period runs from the day on which the last Product is received.

    7.3 How to cancel

    To exercise your right to cancel, you must inform us of your decision to cancel this Contract by a clear statement (for example, a letter sent by post or email). You can:


    • email us at contact@lightsbyluma.com; or

    • write to us at the registered address shown in clause 1; or

    • use the model cancellation form available in the Returns and Refunds Policy.


    To meet the cancellation deadline, it is sufficient that you send your communication concerning the exercise of the right to cancel before the cancellation period has expired.

    7.4 Effects of cancellation

    The effects of cancellation, the deadlines for returning Products, who bears the cost of return, and the timing of refunds are set out in detail in our Returns and Refunds Policy, which forms part of these Terms.


     


     

    8. Consumer Rights and Quality of Products

    8.1 Statutory rights

    As a Consumer, you have legal rights under the Consumer Rights Act 2015 in relation to Products that are faulty, not as described, or not fit for purpose. Nothing in these Terms is intended to affect those statutory rights, which include short-term, medium-term and long-term remedies as follows:


    • Right to reject within 30 days of delivery for a full refund;

    • Right to repair or replacement for faults that appear after that period;

    • Right to a price reduction or final right to reject if a repair or replacement does not resolve the fault.

    8.2 Conformity period

    We are responsible for ensuring that Products conform to the Contract at the time of delivery. Faults that develop within 6 months of delivery are presumed (unless proven otherwise) to have been present at the time of delivery, in line with section 19(14) of the Consumer Rights Act 2015.

    8.3 Manufacturer's warranty

    Some Products may benefit from a separate manufacturer's warranty, the terms of which will be provided with the Product or on request. Any manufacturer's warranty is in addition to, and does not affect, your statutory rights.


     


     

    9. Lighting Products – Specific Provisions

    9.1 Product safety and compliance

    Our lighting Products are designed and supplied in compliance with applicable product safety standards. Where required, Products carry the UKCA and/or CE marking, and are accompanied by appropriate documentation in English. We comply with applicable obligations under UK product safety legislation, including (where applicable) the Electrical Equipment (Safety) Regulations 2016, the Electromagnetic Compatibility Regulations 2016, and the Restriction of the Use of Certain Hazardous Substances in Electrical and Electronic Equipment Regulations 2012 (RoHS).

    9.2 Voltage and standards

    Lighting Products are supplied for use on the UK mains electricity network (230V, 50Hz) unless otherwise stated. Products are intended for indoor use only unless they are expressly described as suitable for outdoor or wet locations, in which case the applicable IP rating will be specified on the product page.

    9.3 Installation

    Some lighting Products require installation involving connection to mains electricity. Such Products must be installed by a competent person, in accordance with all applicable safety standards including BS 7671 (the IET Wiring Regulations). We strongly recommend that you use a qualified electrician for any hard-wired installation. We will not be liable for any loss or damage caused by improper installation, modification, or use of a Product.

    9.4 Use of Products

    You must use the Products only for their intended purpose, in accordance with any instructions, ratings and safety information supplied with the Product. In particular, you must:


    • use only lamps (bulbs) of the correct type, voltage and maximum wattage as indicated on the Product;

    • never operate a Product that is damaged or has a damaged cable or plug;

    • ensure that the Product is suitable for the location and conditions in which it is to be used;

    • supervise children in the vicinity of any lighting Product.

    9.5 Defective Products

    If a Product is defective, please stop using it immediately and contact us at contact@lightsbyluma.com. We will deal with your claim in accordance with the Consumer Rights Act 2015 and our Returns and Refunds Policy.


     


     

    10. Limitation of Liability

    10.1 Liability that cannot be excluded

    Nothing in these Terms limits or excludes our liability for:


    • death or personal injury caused by our negligence;

    • fraud or fraudulent misrepresentation;

    • breach of the terms implied by sections 9 to 16 of the Consumer Rights Act 2015 (description, satisfactory quality, fitness for purpose, samples, models, pre-contract information);

    • defective products under the Consumer Protection Act 1987; or

    • any other liability that cannot lawfully be excluded or limited.

    10.2 Limitation

    Subject to clause 10.1, our total liability to you in respect of any Contract, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall not exceed an amount equal to the price paid by you for the Products giving rise to the claim.

    10.3 Foreseeable losses

    We are responsible for losses you suffer caused by us breaking these Terms, unless the loss is unforeseeable. Loss is foreseeable if it is an obvious consequence of our breach, or if it was contemplated by you and us at the time the Contract was formed.

    10.4 Business losses

    We supply Products to Consumers for domestic and private use. If you use the Products for any commercial, business or resale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.


     


     

    11. Force Majeure

    We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an event outside our reasonable control, including (without limitation) acts of God, war, civil unrest, government action, fire, flood, severe weather, epidemic or pandemic, strike, transport disruption, or failure of public or private telecommunications networks. If a force majeure event prevents performance for more than 30 days, either party may terminate the Contract by written notice and we will refund any sums paid for Products not delivered.


     


     

    12. Intellectual Property

    All intellectual property rights in the Website and in the Products (including text, images, photographs, designs, trade marks, logos and product names) are owned by Florian BOICHUT or our licensors. The brand "LUMA LIGHTS" and any associated logos are protected. You may not reproduce, distribute, modify, publicly display, sell or otherwise commercially exploit any content from the Website without our prior written consent. You are granted a limited, revocable, non-exclusive licence to view the Website for your personal, non-commercial purposes.


     


     

    13. Personal Data

    We process personal data in accordance with the UK GDPR and the Data Protection Act 2018. Full information about how we collect and use personal data is set out in our Privacy Policy and our Cookie Policy, which form part of these Terms.


     


     

    14. Complaints and Alternative Dispute Resolution

    14.1 Complaints

    If you have any complaint, please contact us first at contact@lightsbyluma.com or by post at the address shown in clause 1. We will acknowledge your complaint promptly and aim to resolve it within a reasonable period.

    14.2 Alternative Dispute Resolution

    If we cannot resolve your complaint to your satisfaction, you may be entitled to refer the matter to an alternative dispute resolution body. We are not required to use, and do not currently subscribe to, any specific certified ADR scheme, but we will engage in good faith with any reasonable ADR process.

    14.3 Citizens Advice

    UK Consumers can also obtain free advice from Citizens Advice consumer service (https://www.citizensadvice.org.uk).


     


     

    15. Governing Law and Jurisdiction

    15.1 Governing law

    These Terms and any Contract between us are governed by English law. As you are a Consumer, this choice of law does not deprive you of the protection afforded to you by provisions that cannot be derogated from under the law of the country in which you have your habitual residence (Article 6, Rome I Regulation, as retained in UK law).

    15.2 Jurisdiction

    You and we agree that the courts of England and Wales have non-exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms or any Contract. If you reside in Scotland, you may also bring proceedings in the Scottish courts; if you reside in Northern Ireland, you may also bring proceedings in the Northern Irish courts.


     


     

    16. General

    16.1 Entire agreement

    These Terms, together with the Privacy Policy, Cookie Policy, Shipping Policy and Returns and Refunds Policy, constitute the entire agreement between you and us in respect of any Contract.

    16.2 Severability

    If any provision of these Terms is held by a competent authority to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

    16.3 No waiver

    Our failure to enforce any right under these Terms shall not constitute a waiver of that right.

    16.4 Assignment

    You may not transfer your rights or obligations under any Contract to another person without our prior written consent. We may transfer our rights and obligations under any Contract to another organisation, provided that this does not adversely affect your rights.

    16.5 Third party rights

    A person who is not a party to these Terms shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of these Terms.

    16.6 Changes to these Terms

    We may amend these Terms from time to time. The version applicable to your Contract is the version in force at the date your Order is accepted. Any changes will be posted on the Website with an updated "Last updated" date.
